LEGISLATORS are expected this afternoon to support the repeal of the law that makes homosexuality a crime, but not without considerable reservation, because the majority of the public does not share their view. An opinion poll carried out for the South China Morning Post and published today, shows that only 37 per cent believe that the law should not intrude on the sexual preference of consenting adults. THE public is divided on whether homosexuality between consenting adults should be a punishable offence, an issue which will be debated this afternoon by the Legislative Council.

The debate comes 10 years after the Legal Department began exploring the repeal of Article 49 in the Offences Against the Person Ordinance and seven years after the Law Reform Commission Report suggested its abolition.

An opinion survey by the independent polister, Asian Commercial Research (ACR), sponsored by the South China Morning Post, indicated that just over half of the 623 respondents believed homosexual acts in private between consenting adults should be proscribed by law.

Thirty-seven per cent felt homosexuality was a private choice and should not be regarded as a criminal offence. Continue reading
